Booking Terms & Conditions
Heritage Hikes Australia

These Booking Terms and Conditions govern all bookings and participation in tours offered by Heritage Hikes Australia (ABN 66 102 528 209) (us/we/HHA), an adventure tour operator based in Sydney, New South Wales (Booking Conditions).
By booking and participating in any activity with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking (if accepted by us) will be accepted on this basis. Please read them carefully before proceeding with your booking
For these Booking Conditions, “Services” means our guided walks/hikes tours, camping and any explicitly stated inclusions for the specific activity you book (as listed on the activity’s web page and/or in your Booking Confirmation and activity Itinerary).
1. Booking & Payment
Bookings and payments can be made via our website. A booking is confirmed only upon receipt of full payment as specified at the time of booking.
Children and young adults aged 12-16 years receive a 20% discount off the standard ticket price.
Prices are quoted in Australian Dollars (AUD).
Public Scheduled Walks (listed on our website calendar)
Full payment is taken at checkout to confirm your booking (cards via WooPayments and/or PayPal). A confirmation email and receipt are issued automatically.
All single day walks / activities must be booked and paid in full no later than 7 days prior to the activity taking place. Paid in full means cleared funds in our account. We do not work on terms or remittance advice. Your activity is not secured until it is paid for.
All multi-day walks / activities must be booked and paid in full no later than 21 days prior to the activity taking place. Your activity is not secured until it is paid for.
If any payment is declined, reversed or charged back by your bank or payment provider after we’ve confirmed your booking, we may cancel the booking until cleared payment is received. You remain responsible for the outstanding balance and any third-party dispute/chargeback fees actually incurred by us.
Private/Custom Bookings (e.g. corporate, special-occasion or school groups)
You must get in touch with us via our website to express interest in a private/custom activity. These bookings (e.g., corporate, school or special-occasion groups) are by proposal and must be paid in full to confirm the booking. The proposal will outline price, inclusions, minimum/maximum numbers, and payment timing. We’ll send you a private booking link and these Booking Conditions apply unless we expressly agree something different in writing. Conditions of payment for single and multi-day walks as set out above also apply to private/custom bookings.
2. Acceptance of Booking
Booking, payment and issue of a receipt are automated. If you are making a group booking on behalf of others, you warrant that you have the authority from the rest of the group members to act on their behalf. We reserve the right to refuse to accept a booking based on the information you reveal to us.
3. Cancellations, Changes & Refunds

We’ll move you to any available departure of the same product within 12 months. |
Change-of-mind credits are issued once per booking and must be used within 12 months from the date the credit is issued to you.
Cancellation/Changes by the Participant:
Cancellations must be made in writing (not SMS). Notice of cancellation is not effective until received by Heritage Hikes Australia and must be made during office hours (9am-5pm Monday-Friday) and not on weekends or public holidays when we may be out walking 😊. If you do cancel, cancellation fees may apply.
Whilst all our hiking activities will continue in rain, if safe to do so, we understand that some walkers prefer dryer conditions. If you change your mind/cannot attend or do not want to attend, we can issue you with a change-of-mind credit (valid for 12 months) for another hike. Please note you must give us at least 48 hours-notice before the start time of a single day walk or more than 7 days before the start time of a multiday walk, if this is your choice. Change-of-mind credits are issued once per booking and must be used within the stated validity period. We may extend this validity period if severe weather/closures limit available dates.
If you cancel your activity with more than 48 hours’ notice before the start time of a single day walk or more than 7 days before the start time of a multiday walk, we will rebook your activity on a date of your choice to the best of our ability.
If you cancel your activity within 48 hours before the start time of a single day walk or more than 7 days before the start time of a multiday walk, we cannot offer any refunds or credit notes.
If you do not turn up on time for your activity, we may run the activity without you in attendance and unfortunately cannot offer a refund or credit note in this instance. Please aim to arrive 20 minutes before the start time to avoid this. Please understand it is not possible to make other paying customers wait for you if you are late, all walks start on time.
If you are unable to attend your activity due to injury or illness, please contact us as soon as possible but no later than 24 hours before the start time of the activity and we can arrange a credit note or reschedule for another time. We do not offer refunds in this event as this is a customer cancellation.
Please note that we will only issue a ‘change of mind’ credit note once and will not issue you with another ‘change of mind’ credit note if you change your mind again.
If you do not complete the activity and leave for any reason after it has commenced such as an injury or illness, we are not obliged to make any refunds for unused Services. If you fail to arrive at the pre-arranged meeting place, attempt to join the activity after departure, or leave prior to its completion, no refund will be made.
If you wish to change the date of your activity and transfer from one activity to another you must notify us in writing at least 48 hours prior to a single day walk and 7 days prior to a multiday walk. We will do our best to make the change to your preferred date, but it may not always be possible. The new transfer date must be within 12 months of the original booking date.
A booking may be transferred into another person’s name, but HHA must be notified of that change at least 48 hours prior to a single day walk and at least 7 days prior to a multiday walk. The person must also supply all necessary paperwork such as medical information to HHA at the time of notification.
Heritage Hikes Australia will try to accommodate changes but cannot guarantee availability.
Cancellation/Changes by Heritage Hikes Australia:
Our trips may be cancelled if we do not meet the minimum group size or when a Force Majeure event results in cancellation of a trip (see section 17 below). We may also decide at our discretion, to operate trips with smaller numbers than the specified minimum group size. We will under no circumstance knowingly place at risk the health and well-being of our participants and guides.
If your activity is cancelled by Heritage Hikes Australia due to a safety concern/weather event (bushfire/electrical storm/dangerous winds/etc.) that is beyond our control, we will re-book your activity on a date of your choice to the best of our ability, or issue a credit note for you to redeem at another time.
Please note all weather decisions are made 24 hours before the start of a scheduled walk and not sooner, and they are based on Government BOM information.
If Heritage Hikes Australia cancels your activity for any other reason, we will offer a full refund or rebook your activity on a date of your choice to the best of our ability
If we cancel your trip, you can choose to:
- hold a credit on file towards an alternative trip with a departure date within 12 months; or
- receive a refund of monies paid in full.
We reserve the right to cancel or reschedule any activity due to weather, safety concerns, or insufficient participant numbers.
In the event of cancellation by us, you will be offered a rescheduled date or a full refund.
As our events are held in nature, the unexpected is to be expected. As such, we reserve the right to change or alter a walking route or itinerary based on track closures and safety considerations.
Please note no refunds will be given for minor changes as long as the date of departure, general difficulty and general location of the walk remains similar. We always only make decisions to change routes based on Bureau of Metrological (BOM), NSW National Parks and Wildlife (NPWS) and Rural Fire Service (RFS) advice, customer safety and as fairly as possible. Such changes could include but are not limited to, starting a walk at a different track entry or substituting a part of the walk for another variation in the same area. If a significant change is required before departure, we’ll let you know as soon as reasonably possible and offer a suitable alternative or a refund as per the “Cancellation/Changes by Heritage Hikes Australia” section.
4. Change of itinerary
While we endeavour to operate all activities as described we reserve the right to change the activity itinerary.
We may make reasonable changes to routes or timing for safety or access reasons (BOM, NPWS, RFS advice, track/park closures). Minor changes that don’t materially alter the date of departure, general difficulty, or general location aren’t refundable. If a significant change is required before departure, we’ll let you know as soon as reasonably possible and offer a suitable alternative or a refund as per the “If HHA Cancels” section above.
5. Activity Inclusions / Exclusions
The items below are typical for our activities. Final inclusions/exclusions for your booking are the ones shown on the specific activity page at the time of booking and/or in your Booking Confirmation. Anything not expressly listed as an inclusion is an exclusion.
Typical inclusions (indicative):
- Licensed guide(s) and trip leadership
- Route planning, safety briefings, group equipment as listed
- Park permits/fees where stated
- First aid equipment carried by guide
Typical exclusions (indicative):
- Personal gear (e.g., boots, clothing, backpack) unless stated
- Transport to/from the meeting point
- Meals, snacks, water (unless stated)
- Optional add-ons or hire items not listed as included
- Personal travel/health insurance
6. GST
Terms used in this clause 6 that have a particular meaning in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) (GST Act) have the same meaning in this clause.
All consideration for any taxable supply provided for by these Booking Conditions or any related document or agreement is inclusive of GST unless the contrary is clear.
If an amount of consideration under these Booking Conditions or any related document or agreement is calculated as specific compensation or reimbursement for an expense, loss or liability of a supplier, the consideration must be calculated after excluding any amount for which the supplier is entitled to an input tax credit as recipient of the item to which the expenses, loss or liability relates.
7. Activity Requirements & Your Responsibility
It is your responsibility to thoroughly read the walk / activity descriptions and itineraries and choose one that suits your ability and fitness. Participants must be in good health and be moderately fit to undertake the activity. Some training and preparation work is required prior to departure. The more physically prepared you are, the more enjoyable the activity will be.
You must have adequate fitness for walking the expected hours on each day. The tracks could include rough and uneven terrain, challenging ascents and descents and varying extremes of weather from heavy rain to cool or warm temperatures or strong winds.
Participants are responsible for ensuring they have adequate medication for the entire duration of the activity.
Participants must comply with any policies and operating rules posted by us on our website in respect of our activities.
You warrant that you have sufficient competence, knowledge, common sense, experience, and equipment to participate in the activities in a manner which will be safe to you and others.
We are happy to discuss your suitability for our walks over the phone or via email if you need clarification. It is also your responsibility to bring adequate clothing & footwear to suit the conditions, please refer to our suggested packing list with your pre-departure activity information. It is your responsibility to tell us of any relevant medical conditions or special diet requirements at the time of booking, and we will attempt to cater for these special needs to the best of our ability.
Our minimum age for participation is 12 years (under 18s must attend with a parent/guardian). Participants must have fitness appropriate to the stated walk grade. For some itineraries and/or for participants aged 65 years and over, we require a doctor’s clearance confirming you are fit for the stated grade. Where a medical condition or safety concern is indicated (at any age), we may also request a clearance. If required documentation isn’t provided by the deadline, we may decline participation and treat this as a customer-initiated cancellation per the timeframes above.
For us to confirm your booking, you must provide all requested details with the full payment of the activity. Necessary details vary by activity, and they may include but are not limited to full name, date of birth, any pre-existing medical conditions, hiking and camping experience and dietary requirements. Failure to provide requested details may result in the cancellation of your participation in the activity.
8. Risk Acknowledgement
Adventure activities involve inherent risks including but not limited to:
- environment and terrain risks;
- weather conditions and temperature risks;
- biological risks;
- operational and remoteness risks;
- personal and medical risks;
- behaviour related risks.
By participating in our activities, you acknowledge and accept these risks, including (but not limited to) injury, illness, property damage, and environmental hazards.
All participants will need to sign a ’Risk Warning, Waiver, Release and Indemnity’ form prior to participating in any activity.
You consent to receiving first aid, medical treatment, or evacuation assistance if necessary, during the activities. You agree to reimburse HHA for any associated costs.
You understand that weather conditions can change unexpectedly, which may result in changes, delays, or cancellations in the activities.
HHA and its officers, employees, guides, contractors and agents (Personnel) take their responsibilities seriously and may, at their option, cancel your participation in any of the activities if for any reason HHA’s Personnel believes, in their reasonable discretion, that you should not participate, including if:
- you breach these Booking Conditions;
- you behave in a way that is inappropriate or offensive or commit an illegal act; or
- in the reasonable opinion of the HHA’s Personnel, you behave in a way that causes or is likely to cause danger, distress or annoyance to others,
and you must follow the instructions given by our Personnel.
You agree that:
- you have sole responsibility for your personal possessions before, during and after any of our activities; and
- you must follow the instructions of HHA and its Personnel at all times in connection with any of our activities, including proper use of any safety equipment provided.
You acknowledge that participation in any Heritage Hikes Australia walk or activity involves a more than normal increased degree of personal risk and that you undertake the activities freely, voluntarily and absolutely at your own risk and with a full appreciation of the nature and extent of all risks involved in the walk.
It is your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. Please also see our ‘Risk Warning, Waiver, Release and Indemnity’ form (provided with activity paperwork) for further details.
9. Liability
To the maximum extent permitted by law, unless expressly provided in these Booking Conditions, we exclude all guarantees, warranties, understandings, inducements or representations whether express or implied, statutory or otherwise, which would otherwise be implied into these Booking Conditions. If any legislation implies into these Booking Conditions, any term, condition, warranty or additional obligation that cannot be lawfully excluded (Non-Excludable Guarantee), then that term, condition, warranty or additional obligation will be included in these Booking Conditions only to the extent required by the relevant legislation, but each party’s liability in respect of any breach of that term, condition, warranty or additional obligation will be limited to the maximum extent (if any) permitted by that legislation.
Nothing in these Booking Conditions excludes, restricts or modifies any consumer guarantees under the Australian Consumer Law. To the extent permitted by law, our liability for breach of contract, breach of statutory duty, breach of a condition, warranty, guarantee, negligence, or other tort or other obligation implied by law is limited to any one of the following as HHA decides:
- the supplying the Services again; or
- paying the cost of having the Services supplied again.
Subject to HHA’s obligations under the Non-Excludable Provisions and clause 9.4, HHA’s maximum aggregate liability to you in respect of any one claim or series of connected claims under these Booking Conditions in connection with an activity provided by HHA, whether arising in or for breach of contract, negligence or other tort, breach of statutory duty, or under an indemnity or otherwise is limited to an amount equal to the amount paid by you to HHA for the activity.
Subject to HHA’s obligations under the Non-Excludable Provisions, HHA is not liable to you or any third party for any Indirect Loss arising in connection with these Booking Conditions, or its subject matter, whether arising in or for breach of contract, negligence or other tort, breach of statutory duty, breach of warranty or guarantee, under an indemnity or otherwise and whether or not that loss was foreseeable, even if HHA has been advised of the possibility of such loss.
In this clause, ‘Indirect Loss” means any one or more of the following:
- economic loss, loss of actual or anticipated profits, loss of revenue, loss of savings, loss of production, loss of business, loss of opportunity, loss of access to markets, loss of goodwill, loss of reputation, loss of credit, loss of publicity, loss of data, loss of use, loss of interest or loss arising from business interruption; and
- any special, indirect, consequential, incidental, punitive, exemplary or unforeseeable loss or any similar loss.
10. Recreation Activity
You agree that our services constitute a recreational service within the meaning of section 139A of the Competition and Consumer Act 2010 (Cth) (CCA) as each activity is:
- a sporting event or similar leisure time pursuit; and/or
- other activity that involves a significant degree of physical exertion or physical risk and is undertaken for the purpose of recreation, enjoyment or leisure.
The CCA implies certain Non-Excludable Guarantees into contracts for the supply of certain goods and services, for example, that goods or services will be rendered with due care and skill, that goods or services supplied will be reasonably fit for purpose and that goods or services will be delivered in a timely manner.
Under section 139A of the CCA, we are entitled to ask you to agree (and you hereby agree) that:
- these Non-Excludable Guarantees relating to the supply of services do not apply to you to the extent that you suffer from death, physical or mental injury (including the aggravation, acceleration or occurrence of such an injury), the contraction, aggravation or acceleration of a disease or the damage or loss of property; and
- you will take no course of action against HHA or its Personnel if you are killed or injured because any one or more Activities was not provided in accordance with the Non-Excludable Guarantees.
Note: these changes to your rights as set out in this clause, do not apply if your death or injury is due to reckless conduct by HHA. ‘Reckless conduct’ means any conduct where HHA is aware, or should reasonably have been aware, of a significant risk that the conduct could result in personal injury to another person and engages in the conduct despite the risk and without adequate justification
11. Indemnity
You indemnify us (and all our subsidiaries, officers, employees, contractors and agents) against all losses, claims actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party in connection with:
- your access or use of the Services, this includes your delegate’s access or use of the Services; and
- your behaviour in participating in the activities including your treatment of others participating in the activities;
- your failure to comply with our HHA’s Personnel’s reasonable instructions;
- any breach by you (or your delegate) of:
- these Booking Conditions;
- our policies or operation rules; or
- any additional terms applicable to providing the Services,
except to the extent that such loss or damage as a direct result of our fraud or wilful misconduct.
12. Vicarius Liability
We shall not be held vicariously liable for the intentional or negligent acts of any persons not employed or contracted by us nor for any intentional or negligent acts of our employees or authorised contractors committed while off duty or outside the course and scope of their employment.
13. Safety & Conduct
Our group trips are run by our Guides who are responsible for the activity including group safety, operation of the activity and of course enjoyment. All participants must always follow the instructions of the Guides.
Guides have the authority to do whatever is necessary to achieve these objectives, including the decision to refuse a guest to participate in a specific walk they deem would compromise the overall safety and/or interests of the group. The decision of the Guide(s) is final on all matters likely to affect the safety or well-being of any participant or our Personnel participating in the trip.
If you fail to comply with a decision made by our Guide(s) or interfere with the well-being or mobility of the group, the Senior Guide may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must always comply with the laws, customs, drug and alcohol regulations of Australia and any specific requests or regulations specified by National Parks and Wildlife Service (NSW) and Rural Fire Service (NSW).
14. National Parks and Heritage Sites
You must comply with National Parks regulations, Leave No Trace principles, and heritage protection laws. HHA operates under NSW NPWS Eco Pass licence and adheres to the Adventure Activity Standards (2019) and The Burra Charter (ICOMOS, 2013).
15. Insurance
Travel insurance is highly recommended and should be taken out at the time of booking. When choosing a travel insurance, ensure you have medical and ambulance coverage and a minimum coverage for repatriation and emergency rescue. The policy should also cover you for personal liability, cancellation, curtailment and loss of luggage and personal effects.
Australian residents should ensure their private health care includes specific ambulance cover in case of helicopter evacuations which are not normally covered under domestic travel insurance.
Instances where the injury is not life threatening, but the evacuee is unable to walk out themselves such as sprains, broken limbs, severe fatigue or unexpected illness, evacuations are coordinated by Commercially Operated Helicopter Services.
16. Photography & Media
We routinely capture photos/video on trips. We’ll only use identifiable images of you with your consent via our Media Release form. You can opt out anytime by telling your Guide on the day or contacting us.
Non-commercial personal photography by participants is welcome; commercial use needs our written permission.
17. Force Majeure
Heritage Hikes Australia is not liable for delays, cancellations, or changes caused by Force Majeure.
A “Force Majeure Event” includes but is not limited to, acts of God, fire, earthquake, flood, windstorm or other extreme weather events, war, civil commotion, riot, blockade or embargo, breakdown, union dispute, epidemic, pandemic, lack or failure of courses of supply, passage of any law, order, regulation, ordinance, proclamation, demand, requisition or requirement or any other act of any government authority, outside of the reasonable control of either party whether or not foreseeable, which renders performance impossible or reasonably impracticable.
- If a Force Majeure Event prevents us operating your activity, you may transfer to a new date within 12 months or receive a refund of monies paid less unrecoverable third-party costs we have actually incurred (e.g., non-refundable permits/fees we can’t recover).
- We’re not responsible for your ancillary costs (e.g., transport to/from meeting point, accommodation, meals).
We’ll notify you as soon as reasonably practicable using the contact details you supplied.
18. Privacy Policy
Any personal information that we collect about you may be used for any purpose associated with the operation of an activity or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the activity. We will otherwise treat your details in accordance with our privacy policy (available for viewing on our website, heritagehikes.com.au/privacy-policy).
19. Claims & Complaints
We want to provide you with an enjoyable walking experience, but no matter how careful we are, things might sometimes go wrong. We’d like to have complaints remedied as quickly as possible. If you have a complaint about your trip please inform your Guide at the time so that they can attempt to rectify the problem. If a problem cannot be resolved during your trip, please contact us via email within 30 days of the end of the activity.
20. Entire Agreement
These Booking Conditions constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of our terms and conditions).
Any ambiguities in the interpretation of these Booking Conditions shall not be construed against the drafting party.
21. No Waiver
The failure of us to exercise or enforce any right or provision of these Booking Conditions shall not constitute a waiver of such right or provision.
22. Governing Law
These Booking Conditions are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the appropriate courts of New South Wales.
